This Memorandum ofUnderstanding (MOU) is entered into by the Federal Energy Regulatory Commission's Office of Energy Projects (Commission) and the U.S. Fish and Wildlife Service (FWS)

The purpose ofthis MOU, as required by the Executive Order 13186 (66 FR 3853, January 17, 2001), is to further the purposes ofthe migratory bird conventions, the Migratory Bird Treaty Act (MBTA), the Bald and Golden Eagle Protection Act (BGEP A), the Fish and Wildlife Coordination Act, the Endangered Species Act (ESA), the National Environmental Policy Act (NEPA), and other pertinent statutes. This MOU focuses on avoiding or minimizing adverse impacts on migratory birds and strengthening migratory bird conservation through enhanced collaboration between the Commission and FWS by identifying areas ofcooperation. This voluntary MOU does not waive legal requirements under the MBTA, BGEPA, ESA, the Federal Power Act, the Natural Gas Act, or any other statutes and does not authorize the take ofmigratory birds.
