WHEREAS, the United States of America is about to acquire title to:
The ___________________tract (________), _______________ Refuge, situated in ______________ County, State of _____________, under authority of the Migratory Bird Conservation Act of February 18, 1929 (45 Stat. 1222), and amendments thereto, for use in the conservation of migratory birds; and
WHEREAS, it appears from the abstract of title (or certificate of title) that in order to acquire said land by purchase it is necessary to acquire same, subject to certain rights-of-way, easements, and reservations, and
WHEREAS, the said rights-of-way, easements, and reservations are:
WHEREAS, the said lands are to be acquired subject to said rights-of-way, easements, and reservations;
NOW, THEREFORE, I hereby certify pursuant to and in accordance with the provisions of the resolution of the Migratory Bird Conservation Commission approved at its meeting on June 14, 1938, that in my opinion the said rights-of-way, easements, and reservations, from their nature, will not impair the value of or interfere with the use of the area so encumbered for the purpose for which the said land is being acquired.
